Bicycle Junction Cargo Bike Trial Competition Terms and Conditions
The Bicycle Junction Cargo Bike Trial Competition (“Competition”)isrun by Beautiful Bicycles Ltd trading as Bicycle Junction, 1 Marion St, Te Aro, Wellington 6011(“Bicycle Junction”). The Competition is governed by these Terms and Conditions. By entering the Competition, you (“you, your or Entrant”) accept these Terms and Conditions.
The Competition is open to parents or guardians of students at designated participant schools listed athttps://www.bicyclejunction.co.nz/blogs/news/family-cargobike-trial(“Information Page”), with the exception of Bicycle Junction employees and contractors, and their immediate family members.
Competition Period
3.The Competition will commence on 12:00am on Wednesday 3 February 2021 and end at 11:59pm on Sunday 7 March 2021 (“Competition Period”).
Entry
To enter the Competition, you must:
(a) test ride a cargo bike under the Family Cargo Bike Trial Scheme described on the Information Page, and
(b) complete and submit the entry form online including submitting text, photos and video documenting your test ride at
https://www.bicyclejunction.co.nz/pages/family-cargobike-trial-competition-sign-up,
during the Competition Period (“Entry”).
You may submit only one entry per household.
You are responsible for ensuring that any information provided as part of an Entry is complete and correct. Incomplete, incorrect, indecipherable, illegible or late entries will be invalid.
Bicycle Junction reserves the right, at any time, to verify the validity of any Entry or eligibility of any Entrant and to disqualify any Entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by Bicycle Junction to enforce any of its rights at any stage does not constitute a waiver of those rights.
Draw
Within one week of the conclusion of the Competition Period, Bicycle Junction will select ten finalists (each a “Finalist”). From the ten Finalists, Bicycle Junction will select one winner (“Winner”). Each finalist who is not the Winner will be a runner-up (“Runner-Up”). Bicycle Junction will make its selection by panel decision at its absolute discretion from all valid Entries received during the Competition Period.
Bicycle Junction will announce the Runners-up and the Winner:
(a) at the Family Cargo Bike Picnic, as set out on the Information Page, and
(b) on the Bicycle Junction Facebook page, subject to Bicycle Junction’s discretion,
on Sunday 14 March 2021 (“Announcement Date”). In the event the Family Cargo Bike Picnic event is postponed or cancelled, Bicycle Junction can change the Announcement Date at its discretion.
Bicycle Junction will use its best endeavours to contact the Runners-up and the Winner, including by phone or email using the contact details supplied in the relevant Entry within two weeks from the
Announcement Date. However, if Bicycle Junction cannot contact any Runners-up or Winner during this two week period, Bicycle Junction may at its absolute discretion award the relevant prize(s) to another Entrant.
11. All decisions made by Bicycle Junction regarding this Competition will be final and no correspondence will be entered into.
Prize(s)
The prize for the Winner will be one Yuba Spicy Curry V3 with accessories, used during the Family Cargo Bike Trial as described on the Information Page, with a combined minimum retail value of $8795 (“Winning Prize”). The Winning Prize must be collected from Bicycle Junction at 1 Marion St on Monday 15 March 2021.
The prize for each Runner-up will be a $200 voucher redeemable at Bicycle Junction.
The prizes cannot be transferred, exchanged or redeemed for cash.
Bicycle Junction will use its best endeavours to provide the Winning Prize. If the Winning Prize is unavailable for whatever reason, Bicycle Junction reserves the right to substitute the Winning Prize for an item of an equivalent value.
Personal Information
By entering the Competition, you agree to Bicycle Junction using your personal information to contact you if you are a Runner-up or the Winner. If you are a Runner-up or the Winner, you agree to participate in publicity organised by Bicycle Junction. Each Entrant agrees to the use of their name, likeness, image and any text, image or video content supplied as part of their Entry for publicity and promotional purposes for an unlimited period in any media, without compensation. This includes, but is not limited to, social media and event websites and media releases.
General
Bicycle Junction, in its sole discretion, reserves the right to cancel, suspend, terminate or modify the Competition if fraud, technical failures or any other factor beyond Bicycle Junction’s reasonable control (including in relation to pandemic response measures), adversely affects Bicycle Junction’s ability to conduct the Competition as contemplated in these Terms and Conditions. Any such termination or modification will be notified on the Bicycle Junction Facebook page.
Subject to any applicable laws that cannot be excluded, Bicycle Junction, its employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to indirect or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this Competition or with winning, redeeming or benefiting from any Prize.
These Terms and Conditions shall be governed by the laws of New Zealand and each Entrant agrees to submit to the non-exclusive jurisdiction of the courts of New Zealand.
